By accessing and using the Amber Vault AI website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our Site or services. These Terms constitute a legally binding agreement between you and Amber Vault AI.

Amber Vault AI provides AI automation consulting services, including but not limited to business process automation, AI-powered content and marketing solutions, custom AI development, and AI solutions for earth science industries. The specific scope, deliverables, timeline, and pricing of any engagement will be defined in a separate service agreement between Amber Vault AI and the client.

Free tools and resources available on the Site (including the AI Audit tool, blog content, downloadable guides, and newsletter) are governed by these Terms.

All content on this Site — including text, graphics, logos, images, and code — is the property of Amber Vault AI and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

5. AI Audit Tool

The AI Audit tool provides general recommendations based on your responses. Results are informational only and do not constitute professional advice. Your automation score and recommendations are generated algorithmically and may not account for all factors specific to your business. You should not rely solely on these results for business decisions.

6. Data Processing & Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Site and submitting forms, you acknowledge that you have read and understood our Privacy Policy.

For paid consulting engagements that involve processing client data, a separate Data Processing Agreement (DPA) will be provided upon request to ensure compliance with applicable data protection regulations including GDPR and CCPA.

Our Site may contain links to third-party websites and affiliate links. We may earn commissions from qualifying purchases made through affiliate links. We are not responsible for the content, accuracy, or practices of third-party websites. Inclusion of any link does not imply endorsement.

The Site and its content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no guarantees regarding specific business outcomes, revenue increases, or time savings from our services.

9. Limitation of Liability

To the maximum extent permitted by law, Amber Vault AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or services, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim shall not exceed the amount you paid to Amber Vault AI in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

10. Client Engagements

All paid consulting engagements will be governed by a separate service agreement that outlines scope, deliverables, payment terms, confidentiality, and intellectual property ownership. These Terms of Service govern your use of the website only. In the event of a conflict between these Terms and a separate service agreement, the service agreement shall prevail.

11. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or your use of the Site, the parties agree to first attempt to resolve the dispute informally by contacting us at privacy@ambervaultai.com. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration or the courts, as applicable under the governing law below.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. If we make material changes, we will provide prominent notice on the Site. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Amber Vault AI is registered, without regard to conflict of law principles. Any legal proceedings arising from these Terms shall be brought in the courts of competent jurisdiction in that state.

If you are accessing the Site from outside the United States, you are responsible for compliance with local laws to the extent they apply.

14. Survival

The following sections shall survive any termination or expiration of these Terms: Intellectual Property (Section 4), Disclaimer of Warranties (Section 8), Limitation of Liability (Section 9), Dispute Resolution (Section 11), and Governing Law (Section 13).

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
